Terms and Conditions
1. Scope and Supplier
These terms and conditions apply to contracts concluded through the Pipeloops online shop between Pipeloops, proprietor Reiner Suikat, Am Schwarzen Berge 28B, 38112 Braunschweig, Germany (“Pipeloops”), and its customers.
Pipeloops sells digitally supplied sample sets and related products for the Hauptwerk virtual pipe organ software. The relevant product descriptions and Licence Conditions also apply.
2. Products and System Requirements
The sample sets are intended for use with the versions of Hauptwerk specified for each product. Technical requirements, compatibility, contents and any necessary activation are described on the relevant product page. Use with other software samplers is not supported by Pipeloops.
Purchasing a sample set grants a right of use under the Licence Conditions; copyright and other intellectual property rights are not transferred.
3. Orders and Conclusion of Contract
Products displayed in the online shop do not constitute binding offers. By clicking the button marked “Place order with obligation to pay”, the customer submits a binding offer to purchase the selected products. Before submitting the order, the customer can review and correct the order details.
The contract is concluded when Pipeloops accepts the order by sending an order confirmation by email. This confirmation identifies the products ordered and their prices. The contract terms can be viewed and saved before the order is submitted.
4. Prices and Payment
The prices and taxes shown during checkout apply. The total displayed before the order is submitted is decisive. Payment is available by PayPal or bank transfer. Bank details are provided after ordering where bank transfer is selected.
5. Supply of Digital Products
Products are supplied electronically; no shipping charges for physical goods apply. After full payment has been received, Pipeloops releases the purchased products or required activation codes and informs the customer by email.
For sample sets without iLok protection, access is generally provided through download links in the customer account. For iLok-protected sample sets, installation files may already be publicly downloadable; an individually supplied activation code is required to use the full version.
Supply before the statutory withdrawal period has expired takes place only where the applicable legal requirements have been met. Without express consent to early performance, supply will take place only after the statutory withdrawal period has expired. See the separate Withdrawal Information for details.
6. Statutory Rights in the Event of Defects
Statutory rights in the event of defects apply. For consumers, the statutory provisions on digital products, including requirements concerning conformity, supply and updates, remain fully applicable.
7. Liability
Pipeloops is liable without limitation for intent and gross negligence, injury to life, body or health, under mandatory product liability law, and to the extent of any expressly given guarantee.
In cases of slight negligence involving a material contractual obligation, liability is limited, to the extent permitted by law, to the foreseeable damage typical of the contract. Material contractual obligations are those whose fulfilment is essential for proper performance of the contract and on whose fulfilment the customer may regularly rely. Mandatory statutory claims remain unaffected.
8. Applicable Law
German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. Consumers habitually resident in another country retain the protection of mandatory consumer laws of that country where applicable.
